Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Colorium Lab mobile application (the “App”). By using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Overview

Colorium Lab provides camera‑based color analysis and device calibration tools intended for research, educational, and general informational purposes. The App is not a medical device and is not intended for diagnosis or clinical decision‑making.

2. Eligibility

You must be legally capable of entering into these Terms in your jurisdiction. If you use the App on behalf of an organization, you represent you have authority to bind that organization.

3. Accounts and Authentication

• You may use Firebase Authentication to create or sign in to an account (email/password, Google, or Apple). You agree to keep your credentials secure and notify us of any unauthorized use.
• We may send you verification emails or notices related to your account.

4. License and Acceptable Use

We grant you a limited, revocable, non‑exclusive, non‑transferable license to install and use the App on a device you own or control, solely for its intended purpose.

You agree you will not:

• Reverse engineer, decompile, or attempt to derive source code from binaries or platform code except to the extent permitted by law.
• Circumvent security, App Check, or access controls.
• Use the App to develop or train models that replicate its core features without our permission.
• Upload or share unlawful, harmful, infringing, or confidential content you do not have a right to process.
• Interfere with or disrupt networks, services, or third‑party APIs used by the App.
• Misrepresent results as certified laboratory or clinical measurements.

5. User Content

You retain ownership of content you capture or create with the App (e.g., images, samples, projects, calibration reports). You grant us a limited license to process that content solely to operate and improve the App (e.g., generating a PDF report at your request). Unless you explicitly share or back up data, content remains on your device and is not uploaded to our servers by default.

6. Third‑Party Services

The App integrates third‑party services, including: Firebase (Authentication, Analytics, Crashlytics, Performance, App Check), Google Sign‑In, Sign in with Apple, and the color.pizza color name API. Your use of those services may be subject to their terms and privacy policies. We are not responsible for third‑party services.

7. Exports, Sharing, and Printing

If you choose to export/share content (e.g., PDF reports), the App may create temporary files on your device and invoke platform‑level sharing. You are responsible for how and with whom you share exported content.

8. Safety and Non‑Medical Use

The App is not a substitute for certified laboratory instruments or professional judgment. Do not rely on the App for medical diagnosis, patient care, or decisions in hazardous environments. You are responsible for safe lab practices and compliance with applicable regulations.

9. Intellectual Property

The App, its UI, code, text, graphics, and other materials are owned by us or our licensors and are protected by intellectual property laws. Except for the limited license above, no rights are granted to you.

10. Updates and Changes

We may update or modify the App (including adding or removing features) at any time. We may update these Terms; continued use after changes constitutes acceptance. Material changes may be communicated in‑app.

11. Termination

We may suspend or terminate your access for any breach of these Terms or if required by law. You may stop using the App at any time and may request account deletion (see Privacy Policy).

12. Disclaimers

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR‑FREE, SECURE, OR UNINTERRUPTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

14. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the App or your breach of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your Country/State], without regard to conflicts of law principles. You agree to the exclusive jurisdiction and venue of the courts located in [Your City and Country/State]. If mandatory arbitration or consumer protection rules apply in your jurisdiction, this section will be interpreted accordingly. Update this section to reflect your actual legal entity and venue.

16. Export Controls and Sanctions

You represent you are not located in, under the control of, or a national or resident of any country or person subject to embargoes or sanctions. You agree to comply with applicable export control laws.

17. App Store Terms

If you obtained the App through Apple App Store or Google Play, your use of the App may also be subject to their terms and policies. To the extent those terms limit or supersede these Terms, they will control for that distribution channel.

18. Severability; Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.
